Appraisals & Management of Personal Property

Divorce & Mediation

The BCG appraiser of tangible property is often called by the judge, the lawyers, or the parties to place a value on the residential contents of the marital residence, for equal distribution of assets. The BCG appraiser examines, photographs, measures, and describes each item over $100.00 in the home. A documented report lists current fair market values (not retail or replacement) for all appraised items.

In settlement, the husband and wife take the contents based on utility, need, and appraised value until the division of property is equitable. If the couple cannot agree on the appraised value, the dissenting partner usually hires his/her own appraiser. A war of opinions ensues, and usually the case is brought to trial.

In such litigation, the BCG appraiser remains unbiased throughout the process.

Another route to settlement of property disputes in divorce in through mediation.

Mediation is a private and informal way of settling a dispute between husband and wife without relying on a judgment issued by a judge or jury. A mediator is an unbiased third party who facilitates a settlement between the parties. When an agreement is signed by both parties, it is taken to the court and becomes legally binding.

A BCG appraiser can be invaluable in this process. The appraiser is a nationally certified, unbiased appraiser of fine and decorative arts, residential and office contents, and all types of personal property. Recent disputes that we helped resolve included an engagement ring, an elaborate sterling silver Menorah purchased while on the honeymoon, and a sailboat. All situations involved lengthy disputes, which were resolved through the use of BCG appraisals. How does this happen? The appraiser provides a Fair Market Value of the disputed items or collection, supplies context in the marketplace, and provenance – ownership history - and submits the dollar amount to both parties. This objective documentation facilitates communication and expedites resolution. How does this happen?
